Judgment
The plaintiffs in O.S.No.436/2020 on the file of Munsiff Court, Chalakudy, filed this original petition seeking issue of direction to court below for simultaneous disposal of Exts.P3 [I.A.No.7/2021] and P6[I.A.No.10/2021] in accordance with law.
I heard the learned counsel appearing on both sides.
Ext.P3 Interlocutory application was filed by the defendants in the suit for auctioning the gold ornaments kept in the bank and pending that interlocutory application, the petitioner filed Ext.P6[I.A.No.10/2021] for sending the disputed pledged letter for gold loan for comparing the disputed signature.
The learned counsel for the respondents submitted that he filed objection to Ext.P6 and both applications are pending consideration.
After having heard the submissions made on behalf of the parties, I am of the opinion that in the nature of contentions raised by parties, it is fair enough for the court below to take up both applications simultaneously and decide them in accordance with law after hearing parties.
In the result, original petition is disposed of calling upon the court below to take up Exts.P3 and P6 applications together and dispose them of in accordance with law after hearing parties. It is made clear that I have not expressed any views on merits of the contentions raised by the parties.
All pending interlocutory applications will stand closed.
