O. Girijakumari and F. Khumaini vs The Deputy Director of Education, The District Educational officer and The Assistant Educational officer

T.R. Ramachandran Nair, J.—The first Petitioner is working as Part-time Sanskrit Teacher and the second Petitioner is working as Part-time Arabic Teacher in N.S.S U.P. School, Punukkannoor. Aggrieved by the staff fixation order which resulted in abolition of their posts, they have filed an appeal before the first Respondent-Deputy Director of Education as per Ext. P3. The learned Counsel for the Petitioners pointed out that actually, the Assistant Educational Officer had sanctioned the posts but the District Educational Officer conducted a review and thereafter the posts were abolished which is not justified. It is pointed out that the Petitioners are not getting salary also. In view of the above, there will be a direction to the Deputy Director of Education to take a decision on Ext. P3 appeal after hearing the Petitioners and the Manager within a period of two months. The Petitioners will produce a copy of the writ petition along with a copy of the judgment before the first Respondent for compliance. The writ petition is disposed of as above. No costs.
