This is second repeat application filed under section 438 Cr.P.C seeking anticipatory bail as he apprehending his arrest in connection with Crime No.161/2020 registered at police station Kayatha, district Ujjain for the offence under section 384, 294 & 506 IPC. The first application was dismissed vide order dated 4.9.2020 in MCRC No.30220/20. Thereafter the applicant has filed a petition under section 482 Cr.P.C i.e. MCRC no.33660/20 .Vide order dated 6.10.20 this court has partly allowed the petition by converting the offence from section 384 to section 385 IPC maintaining the sections 294 & 506 IPC.
The first bail application was considered for the offence under section 384 IPC which is non bailable but now section 385 is bailable, hence in view of the order passed in MCRC No.33660/20 the present application has rendered infructuous. Accordingly, it is dismissed as infructuous with direction to the applicant to co-operate with the investigation.
