Judgment
Arindam Lodh, J
Heard Mr. Raju Datta, learned counsel appearing for the petitioner. Also heard Mr. D.J. Saha, learned counsel appearing for Sri Pranbandhu Das, Smt. Nibedita Das and Smt. Rina Das i.e. the respondent nos. 5, 6 and 7; Mr. K. De, learned Addl. G.A. appearing for the State-respondents and Mr. B. Majumder, learned Dy. S.G. appearing for the respondent-Union of India.
The petitioner, Smt. Nupur Das has filed this writ petition praying for direction to the official respondents to sanction and release the special family pension since she is a divorcee, and dependent upon the pension of her deceased mother. She submitted several representations before the official respondents, but, her matter was not considered.
The private respondents are her full-blooded brother and sisters. They are present in the court and during the course of hearing, they voluntarily expressed their willingness to give no-objection certificate in favour of their sister, the petitioner herein, so that the official respondents may sanction and release the special family pension in favour of Smt. Nupur Das.
It is revealed that there are some family disputes amongst the petitioner and the private respondents. They have settled their disputes in the court itself. It is also informed to the court that criminal cases are also pending before the court and all the parties have mutually agreed to withdraw their criminal cases. Considering the relations between the parties and the nature of disputes, the cases may be withdrawn from the concerned courts. They have happily left the proceeding of the court with the aforesaid resolutions.
The settlement papers duly signed by the petitioner and the private respondents have been kept with the record and certified copies of the said papers may be provided to the parties, if they so desire.
In view of this, I direct the official respondents to complete all formalities to sanction and release the special family pension in favour of Smt. Nupur Das within four weeks from the date of receipt of copy of this order.
With the directions as indicated above, the instant writ petition stands disposed.
