Judgment
In this contempt petition, the petitioners have alleged deliberate disobedience by the respondents of the interim order dated 30.06.2017 as
passed by this Court in WP (C) No.186 of 2017, whereby the resolution of the Executive Council dated 14.06.2017 and consequential
notification dated 14.06.2017 were stayed and the respondents were directed to continue to pay Hill Area Special Allowance to the teaching and
non-teaching staff of North Eastern Hill University till the next date. In the totality of facts and circumstances of the case, this Court found it just
and proper to finally hear and dispose of the writ petition itself and hence, notices were not issued in this contempt matter.
The said writ petition [WP (C) No.186 of 2017] has been dismissed by a separate order passed today with this Court finding no reason to
interfere with the decision of the respondent-University, as taken pursuant to the directions of the Visitor that were binding on the University in
view of the overriding powers available with the Visitor under Section 8 of the North Eastern Hill University Act, 1973.
For the view taken by this Court in the writ petition, there appears no reason to continue with this contempt matter any further. Accordingly, this
contempt petition stands dismissed.
