Prayer in this petition is for setting aside terms and conditions in notice inviting e-Tender dated 17.03.2023 (Annexure P-3) and corrigendum thereof dated 21.03.2023 (Annexure P-4) and 22.03.2023 (Annexure P-5) issued by respondent no.2 for procurement of once-used serviceable 50 Kg 'B' Twill jute bags for packing of wheat/food grain from various suppliers of India.
Learned counsel for respondents submit that this writ petition is rendered infructuous by efflux of time. There was no interim order passed in this writ petition and work was allotted to successful bidder on 7. 04.2023. Period of tender was for Rabi Marketing Season, 2023. The work has been successfully completed by successful bidder and no cause of action survives.
There is no representation on behalf of petitioner. Perusal of file reveals that none had appeared on behalf of petitioner even on the last date of hearing when this writ petition was taken up for hearing. However, we do not find any justification for continuation of present proceedings in the given factual matrix.
In the given facts and circumstances, this writ petition is accordingly disposed of as infructuous with liberty to petitioner to file appropriate application within four weeks in case of any subsisting grievance or the incorrect facts being placed before us.
