Judgment
Appellant is the writ petitioner. According to the appellant, he has been granted an allotment order under the liquor policy of the State and he has invested money and, still, the liquor is not being made available. He was also given the supply order on 2nd June, 2017 and, still, he has not been given the quantity of liquor he is entitled to under the law. It is, accordingly, that he approached the learned Single Judge. The learned Single Judge called for the pleadings and did not grant any interim order. Hence, the appeal.
We heard Mr. Shobhit Saharia, learned counsel for the appellant and Mr. H.M. Bhatia, learned Brief Holder for the State.
We asked the learned Brief Holder to get instructions in the matter. According to the learned Brief Holder, the formalities were complete and a report was called for.
According to the appellant, he is a loser on a daily basis. It is also pointed out that the appellant had produced a judgment of the coordinate Bench as per which the court has held that, within 48 hours of the formalities being complied with, supply should be made available.
In the circumstances of the case, we dispose of the appeal as follows:
We record the submission of Mr. H.M. Bhatia, learned Brief Holder that counter affidavit in the writ petition will be filed by 20th June, 2017. Learned counsel for the appellant submits that rejoinder affidavit will be filed by 21st June, 2017. We direct that the writ petition be listed on 22nd June, 2017 in the Daily Cause List. We request the learned Single Judge to dispose of the matter at the earliest and, if possible, on the same day. All the contentions of the appellant are left open.
Let a certified copy of this judgment be issued today itself.
