Through this petition, the petitioner seeks cancellation of anticipatory bail granted by the learned Additional Sessions Judge, Ambala, vide orders dated

19/25.08.2020 (Annexure P-2), to respondents No.2 and 3 in FIR No.109 dated 07.08.2020 under sections 420, 406, 370, 506 and 120-B IPC and

Section 24 of the Immigration Act, 1983, registered at Police Station Naggal, District Ambala.

Learned counsel for the petitioner submits that respondents No. 2 and 3 are the habitual offenders and have cheated a number of persons in the area

and respondent No. 2 and his family members are the hard-core criminals.

Copy of reply by way of affidavit dated 20.02.2021 of the Deputy Superintendent of Police, Ambala, already filed in the Registry, is taken on record.

I have gone through the aforesaid reply.

As per the reply, during the inquiry on a complaint dated 6.10.2020 given by the complainant to the SHO, P.S. Nangal, Ambala, the complainant made

a statement on 08.12.2020 that no such incident took place and he had filed the complaint at the instance of some person and that he did not want to

pursue the said complaint.

The learned State counsel points out that the complaint is of 06.10.2020, whereas the statement of the complainant was recorded on 08.12.2020. He,

thus, contends that having given the aforesaid statement, the complainant cannot turn around to seek cancellation of the bail granted to respondent

Nos. 2 and 3.

In view of the above, the present petition is dismissed.
