Heard learned counsel for the petitioners and learned A.G.A.

Argument is that in view of the allegations made in the first information report itself it is clear that initially petitioner purchased plot from a society and thereafter she transferred the same to the first informant and thus if something is wrong in respect to the rights/title in respect to the land is found, that can be attributed to the society/office bearers and for that Janardan Pant has been named as accused in the first information report and thus so far petitioner is concerned, she being the honest lady, having purchased the plot in good faith is entitled to get protection of this Court, during investigation.

Notices meant for respondents no. 1 to 3 have been accepted by the learned A.G.A.

Issue notice to respondent no. 4. Steps will be taken within ten days.

List this case in the week commencing 13th July, 2009.

Counter affidavit may be filed by the next date.

In the meantime it is directed that till the next date of listing or till submission of charge sheet under Section 173 Cr. P.C. petitioner will not be arrested pursuant to the first information report registered at case crime no. 54 of 2009, under Sections 419, 420, 467, 468, 471, 474, 447, 448 IPC, Police Station Krishna Nagar, district Lucknow. However, investigation may go on to which petitioners shall cooperate.
