The writ petitioner is the daughter of one Girija who is alleged to be suffering from mental disease – Schizophrenia. Ext.P1 dated 10/01/2001 and Ext.P5 dated 28/06/2022 are the certificates, in the said regard, issued from the Medical College Hospital, Thiruvananthapuram. The petitioner has moved an application under Section 14 of the Rights of Persons With Disabilities Act, 2016 before the Revenue Divisional Officer, Kollam seeking her appointment as the guardian of Girija for the purpose of dealing with her properties (Ext.P4).

The learned Special Government Pleader, on instructions, points out that the property of Smt.Girija is situated in Chithara Village which falls within the jurisdiction of Sub Divisional Magistrate Court, Punalur.

In the light of the above, it is ordered that 1st respondent shall cause Ext.P4 application to be forwarded to the Sub Divisional Magistrate, Punalur forthwith. Petitioner shall produce copy of Exts.P1 and P5 certificates before the Sub Divisional Magistrate, Punalur for proceeding further in the matter. Let orders be passed on the application by the Sub Divisional Magistrate, Punalur, as expeditiously as possible and at any rate, within a period of three months from the date of receipt of a copy of this judgment.
