Learned Additional Advocate General has produced compliance affidavit of Director Health Services, Himachal Pradesh alongwith Office order dated 16.10.2023, whereby case of the petitioner has been considered and decided. The same is taken on record. Relevant portion of the order is extracted as under:-

“And now therefore, in view of the above narrated facts and circumstances, the service of the petitioner are hereby ordered to be regularized from a retrospective date in the year November 2008 i.e. the date when the services of his juniors had been regularized after completion of 8 years of their daily waged services, as per his initial claim.

However, the monetary benefits shall be restricted to three years from the date of filing the CWP No.806/2022 on 27.1.2022 i.e. from 28.1.2019. The above benefits is, however further subject to the final outcome of the Review Petition so filed as well as the SLPs preferred in other connected matters by the State of HP and the other available legal remedies with the Respondent State and the Department.

With the above observations, the case of the petitioner is hereby disposed of in terms of above decision. The copy of the above decision be also supplied to the all the concerned including the petitioner concerned for information.”

In view of aforesaid fact, present petition is closed and disposed of with a direction to the respondents to ensure payment of arrears, if any, on or before 31.01.2024. Needless to say, petitioner shall be at liberty to avail appropriate remedy, as available under law, if anything still survives to be redressed.

Pending miscellaneous application(s), if any, shall also stand disposed of.
