Judgment
V.K. Bali, J.—Mrs. Nirmala Devi, a JBT Teacher in Govt. Primary School, Nawan Kot, Amritsar through present petition filed by her under Article 226 of the Constitution of India, seeks issuance of writ in the nature of certiorari so as to quash order dated 14.1.1999 by which she was transferred from Government Primary School, Nawan Kot to Govt. Primary School, Bohru, District Amritsar.
All that has been urged in support of this petition is that during a period of 33 years, that the petitioner put in service, she has not been accommodated at the place of her choice even once as also that she is a chronic patient and her husband is also living at Amritsar where she made request to be posed and which was also at one time favourably considered.
In the written statement that has been filed in the matter, it has been specifically pleaded that the present place of posting of the petitioner is only 5-6 Kms. from Amritsar, where her husband is posted, whereas the school where she has been posted now is on the main road. In my considered view, nothing survives for con- sideration. All the contentions raised on compassion would have had some meaning if perhaps the petitioner was posled at far off place from Amritsar, thus, being away from her husband but the very fact that she is posted only 5-6 Kms. from Amritsar, knocks out all her compassionate grounds, as referred to above. No merits. Dismissed.
Petition dismissed.
