Prayer in this petition, filed under Section 439(2) Cr.P.C., is for cancellation of regular bail granted to respondent No. 1/accused in case FIR No. 196 dated 26.12.2020, registered under Sections 363, 366-A, 376 of the IPC and Section 4 of the POCSO Act, 2012 at Police Station Machhiwara Sahib, District Khanna, vide order dated 09.03.2021 passed in CRM-M-10055-2021.
Learned counsel for the petitioner/complainant as well as learned counsel for respondent No. 1/accused have stated at bar that the boy and girl are residing together as husband and wife.
Reply, on behalf of the respondent-State, has been filed today in Court, in which, the details of the FIR as well as investigation conducted by the police have been given. It is also stated that the case is now fixed for prosecution evidence on 16.12.2022. It is further stated in para 7 that though it alleged by the complainant that respondent No. 1 and co-accused Gursewak Singh are pressurizing him to effect a compromise, however, no such complaint is received by the police.
In view of the above, no ground is made out to cancel the bail, granted to respondent No. 1/accused.
Accordingly, the present petition is dismissed.
