Judgment
Kurian Joseph, C.J.—The writ petition has been filed with the following prayer:
(i) That the respondents No. 1 to 3 be directed to issue order of appointment pursuant to the selection by the Public Service Commission (Respondent No. 4).
(ii) That the appointment order when issued may be given effect to with retrospective effect alongwith back wages and benefit of service for all intents and purposes.
(iii) That the interim order, Annexure A-7, dated 8.8.1994 passed in the O.A. dated 10.8.1994 filed by the respondent No. 5 suitably be modified to the extent the appointment order of the applicant could be issued.
It is seen that O.A. No. 1018 of 1994 has since been disposed of by the judgment, dated 11.8.2010. The text of the judgment reads as follows:
The petitioner has already made representations for the redressal of her grievance vide Annexures P-8 to P-12, dated 01.08.1984, 06.01.1994, 24.01.1994, 03.02.1994 and 02.05.1994, respectively. However, the same have not been decided till date.
Consequently, the Secretary (Health), Government of Himachal Pradesh is directed to decide the representations made by the petitioner vide Annexures P-8 to P-12 by a speaking order within a period of three months from the date of receipt of a certified copy of this judgment. The Secretary (Health) shall also take into consideration the law laid down by this Court in Shakuntla Devi v. State of Himachal Pradesh and Ors. 1998 (2) Sim. L.C. 18. It is made clear that in case the services of the petitioner are regularized, the period spent by her on ad hoc basis will be counted for the purpose of interment/pensionary benefits towards the qualifying service.
With the aforesaid observations/directions, the petition stands disposed of, so also the pending application(s), if any. No costs.
In the above circumstances, this petition is disposed of directing the first respondent to take appropriate action in the case of the petitioner based on the outcome of the action taken pursuant to the direction issued in the judgment, referred to above, within a period of two months from the date of production of the copy of this judgment by the petitioner before the first respondent.
The writ petition stands disposed of, so also the pending application(s), if any.
