1/ Submission were made on IA No. 9117/2019 which is an application for permission to compromise and IA No. 9118/2019 which is compromise memo which has been preferred by appellant Nirbhay Singh and complainant Chandkhan.

2/ Appellant Nirbhay Singh was convicted vide judgment dated 31/5/2018 under the provisions of Section 420 of IPC in ST No. 408/2015 and was sentenced to two years of RI and Rs. 10,000/- of fine with three months default imprisonment. Alongwith Nirbhaysingh, accused Ramesh was also convicted and sentenced in identical manner. The charge which was framed against the accused under Section 420 of IPC was as follows:

आपने सहअभियुक्त के साथ मिलकर सितम्बर-2013 में चांद भाई की भैस छल से प्राप्त करने का सामान्य आशय निर्मित किया उक्त सामान्य आशय को अग्रर करते हुये, आप मै से रमेश ने एक भैस कीमत 75,000/- व निर्भयासिंह ने एक एक भैस कीमत 78,000/- रूपयें चांद भाई को यह असत्य प्रंवचना देकर कि आप अभियुक्तगण अपने खाते से भुगतान का चैक दे रहे है, ग्राम पंचायत के खाते का 1.12.2014 की तारीख का चैक क्रमांक 30444 यह जानते हुये कि उसका भुगतान सम्भव नही, चांद को देकर बेइमानी से चांद खां की भैस प्राप्त कर छल किया है ? जोकि भा.द.सं. की धारा-420 (या 420 सहपठित घारा-34) के तहत दण्डनीय अपराध होकर मेरे संज्ञान में है।

3/ The gist of charge was that both of them purchased the buffaloes for Rs. 75,000/- and Rs. 78,000/- from Chandkhan and made payment to him through cheque No. 30444 which pertained to village panchayat. As the cheque was not encashed no loss occurred to the village panchayat and the state government. However, loss did occur to Chandkhan and Chandkhan has entered into the compromise with Nirbhay Singh

4/ The factum of compromise has been recorded by Principal Registrar and report of Principal Registrar is dated 8/1/2020 in which it has been stated that compromise is voluntary act on the part of the complainant.

Consequently the permission for compromise is granted and consequently appellant Nirbhay Singh is acquitted from the charge framed under Section 420 of IPC. Any amount deposited by Nirbhay Singh by way of fine be returned to him.
