Judgment
K.C. Puri. J.—This is a petition under Article 227 of the Constitution of India for setting aside the impugned order dated 9.8.2010 and order dated 10.12.2011 passed by Civil Judge (Senior Division), Ambala vide which the application u/s 151 C.P.C. moved by the Decree-Holder for re-calling the order dated 6.3.2010 and order dated 24.4.2010 passed by the trial Court was dismissed holding that the trial Court has already dealt with the issue for impleading the subsequent vendee as party to the suit. The learned trial Court after hearing the learned counsel for the parties dismissed the objection vide order dated 9.8.2010 holding that the executing Court cannot go beyond the decree passed by the trial Court.
Feeling dissatisfied with the aforesaid order dated 9.8.2010, the petitioner has preferred the present revision petition.
The executing Court has rightly held that it cannot go beyond the judgment and decree passed by the trial Court. The warrant of symbolic possession only has been issued. Since in the main case, the similar objections were taken and decided by the trial Court and as such the present revision is without any merit and the same stands dismissed. A copy of this judgment be sent to the trial Court for strict compliance.
