Judgment
J.V. Gupta, C.J.—This petition under Article 227 of the Constitution of India is directed against the order of the Motor Accident Claims Tribunal dated 3-12-5990 whereby the application filed on behalf of the claimant under Order Its and Rule 17-A of the CPC seeking permission to tender into evidence she copy of the Registration Certificates of Jeep No. USC-6944, was declined
After the close of the evidence, the claimant wanted to produce on record the Registration Certificate of the said jeep in order to show his ownership which prayer was declined on the ground that it was. no stage to re-open the case.
After hearing the learned counsel for the parties, I find that the-whole approach of the learned Tribunal was wrong and, thus, he acted illegally in the exercise of his jurisdiction. The production of the sad Regulation Certificate was necessary to determine the real controversy between the parties and the same should have been allowed on payment of costs, if any.
4 Consequently, the petition succeeds and the same is allowed. The impugned order is set aside and the paid Registration Certificate is permitted to be produced on record on payment of Rs. 200/- as costs.
The parties are directed to appear before the Tribunal on 15-3-1991, in case there is no other date fixed by the Tribunal.
