The petitioner assails order dated 28.11.2022 (Annexure P-6) passed by Deputy Commissioner, Sonipat, whereby his request for transfer of arms licence of his father aged 75 years to his name has been turned down. The operative portion of the said order read as under:
“Whereas, in compliance of the above directions the reports as received from the Superintendent of Police, Sonipat and Sub-Divisional Magistrate, Ganaur & all relevant facts were examined and it has been found that, under the Heirloom policy only weapons can be transferred to the legal heir of the licensee after obtaining a fresh license and there is no provision of transfer of the Arms License as claimed by the applicant. Further, the State Government has started online applications of Arm License related services in the state w.e.f.01.07.2022.
In view of the circumstances discussed above, the applicant(Legal Heir) can apply online as per the laid down aprocedure/policy of the Govt. on Saral Portal, so that the same will be considered as per requisite guidelines.”
The appeal filed by the petitioner also stands dismissed by Divisional Commissioner vide order dated 24.8.2023 (Annexure P-8).
Having heard the learned counsel for the petitioner but without commenting anything as regards the merits of the case, the instant petition is disposed of with liberty to the petitioner to apply afresh for issuance of a license under the Heirloom policy. In case, any such application is made, the same shall be considered in accordance with law expeditiously without being influenced by orders dated 24.8.2023 and 28.11.2022.
