Nimmo @ Nimo, accused in FIR No.152 dated 21.08.2019 registered at Police Station City Budhlada, District Mansa for offence punishable under

Sections 302, 148 and 149 IPC prays for grant of regular bail, pending trial.

Heard.

Notice of motion to the Advocate General, Punjab.

Mr. Mehardeep Singh, Addl. AG, Punjab, appears on behalf of State of Punjab.

Counsel for the petitioner would argue that all the family members of Labh Ram including his wife, two sons and three daughters and husband of the

petitioner have been involved in the crime to make the net wider. It is further argued that no injury sustained by the deceased has been attributed to

the petitioner and non-applicants Aarti and Kammo. The petitioner is in custody since September, 2019 and till date none of the witnesses has been

examined by the prosecution. The last submission made by counsel is that the petitioner is ready to face trial without any default.

Counsel representing State of Punjab has opposed the prayer for bail with the submission that petitioner was also one of the members of unlawful

assembly that caused injuries to the deceased. She has been specifically named in the FIR and attributed a role that she had been hurling abuses and

even assisted in dragging the deceased inside her parental house subsequent to affliction of injuries to the deceased by Bunty and Bhindi @ Bhinder.

The petitioner is in custody since September, 2019 and no longer required for the purpose of investigation. None of the injuries sustained by the

deceased has been attributed to the petitioner. Till date none of the prosecution witnesses has been examined. There is no allegation that petitioner

does not have a permanent place of stay or likely to flee from process of justice in case enlarged on bail.

Without meaning to express any opinion on merits of the case, bail to the petitioner subject to her furnishing bail bonds to the satisfaction of trial

Court/Additional Sessions Judge (on duty), Mansa. However, she shall abide by the following conditions:-

(i)She shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade

him/her from disclosing such facts to the Court or to any police officer; and

(ii)She shall not leave India without previous permission of the Court.
