Judgment
Petitioners have preferred this misc. petition seeking protection of life and liberty.
It is contended by learned counsel for the petitioners that petitioners are major. They have contacted marriage. Certificate of registration of
marriage is annexed with the petition.
Co-ordinate Bench of this Court in Smt. Nisha Tanwar vs. State of Rajasthan (S.B. Criminal Writ No.493/2016), decided on 30.11.2016 allowed the
petition and directed the S.H.O. concerned to ensure necessary vigil so that no harm is caused to the life and liberty of the petitioner at the hands of
those who are opposing the marriage.
It is contended by learned counsel appearing for respondent Nos. 4 & 5 that petitioner No.2 has criminal antecedents. Petitioner has been booked in
a case under Section 376/511 of IPC.
I have considered the contentions.
In view of the fact that petitioners are major and are married, which fact is established from the certificate of registration of marriage, they have
right for protection.
Accordingly, the misc. petition is allowed. Stay application stands disposed of.
Respondent No.3 is directed to ensure necessary vigil so that no harm is caused to the life and liberty of the petitioners from their relatives.
