Learned counsel for the petitioners has filed a Memo dated 30.10.2024 seeking withdrawal of the petition. The same reads as under:
“Pursuant to the filing of this Petition and issue of notice, the Petitioner’s application has been considered by the Respondents and the Petitioner has been given an appointment in the Respondent’s Department. Since, the petition having become infructuous, Petitioner doesn’t want to pursue the same and seeks permission of this Hon’ble court to withdraw the above petition. Therefore, the above petition may kindly be dismissed as withdrawn in the interest of justice and equity.”
Learned counsel for the answering respondents has also filed a Memo dated 26.11.2024 stating that the petition has become infructuous since prayer has been substantially granted. The Memo dated reads as under:
“The undersigned herewith craves the leave of this Hon’ble Court to produce the copy of the offer of appointment of Petitioner No.1 to the cadre of Tax Assistant on compassionate grounds vide file No.GCCO/II/31/95/2024-ESST-O/o Pr.CC-CGST-ZONE-BENGALURU dated 25.10.2024 and copy of the letter dated 08.11.2024 indicating that the Petitioner No.1 had reported for duty by accepting the said offer letter dated 25.10.2024 are herewith produced in support of the aforementioned case.
WHEREFORE, it is humbly prayed that this memo along with the documents stated above be taken on record in the interest of justice and equity.”
In view of the above, writ petition is disposed off as having become infructuous.
