Broadly speaking, prosecution case is that on 06.05.2026, the accused/applicant along with two co-accused persons robbed the complainant de facto of Rs. 6,39,640/-. According to prosecution, at the time of the alleged robbery, the complainant de facto carrying the money bag was driving his moped and at that time, the accused/applicant with two co-accused persons came on motorcycle and kicked the moped due to which the complainant de facto fell down and the accused persons fled with the money bag.

Learned counsel for accused/applicant submits that the alleged incident took place on 06.05.2026 but the FIR was lodged on 08.05.2026, for which delay there is no explanation.
