Judgment
A. Badharudeen, J
This Crl.M.C. has been filed under Section 482 of the Cr.P.C. and the petitioner seeks quashment of Crime No. 848/2021 of Sooranadu Police Station in Kollam District which has pending as C.C. No. 313/2021 on the files of the Judicial First Class Magistrate’s Court (Temporary), Sasthamcotta.
Heard the learned counsel appearing for the petitioner and, the learned Public Prosecutor and also heard Adv. Anjana.S appearing for the 2nd respondent/de facto complainant and wife of the 1st accused.
It is submitted by the learned counsel appearing for the petitioner as well as the learned counsel appearing for the 2nd respondent that the matter has been settled and the petitioner and the 2nd respondent decided to dissolve the marriage by way of settlement. Therefore, there is no meaning in continuing the criminal proceedings and the same would adversely affect their personal interest.
The learned Public Prosecutor also submitted that the de facto complainant filed an affidavit in this matter suggesting the so-called settlement.
Having appraised the contentions, there is no meaning in continuing with the above case further. Therefore, all further proceedings in Crime No. 848/2021 of Sooranadu Police Station, Kollam district which is pending as C.C. No. 313/2021 on the files of the Judicial First Class Magistrate’s Court (Temporary), Sasthamcotta stands quashed.
The Crl.M.C. stands allowed as above.
