This bail application has filed under Section 439(2) of Cr.P.C for cancellation of bail granted to respondents no.2 to 7 vide order dated 17/02/2022.
Counsel for respondents submits that this application is virtually rendered infructuous for the reason that the order which is sought to be cancelled whereby respondents have been granted bail under Section 438 of Cr.P.C has lost its efficacy for the reason that after granting bail to the respondents some additional sections have been added, therefore, further order of bail was considered by the Court and bail has been granted.
Under such a circumstance, the order dated 17/02/2022 passed in M.Cr.C.8420/2022 infact does not exist and question of cancellation of said order does arise. If any application for cancellation is required to be filed, the same can be filed for cancellation of subsequent order of bail granted to respondents no.2 to 7.
Considering the submission, this application is dismissed with liberty if still petitioner is seeking cancellation she can move a fresh application seeking cancellation of subsequent order granting bail to respondent no.2 to 7.
