The Insurance Company, who was arrayed as 3rd respondent in O.P.(M.V) NO.758/2010 on the file of the Motor Accidents Claims Tribunal, Vatakara, has preferred this appeal challenging the award dated 19.10.2012 whereby the Tribunal granted Rs.7,55,000/- as compensation in favour of the legal representatives of the deceased.
When the matter is taken up for hearing, it is fairly submitted by the learned counsel for the appellant that even though this appeal was filed on the allegation that the amount granted by the tribunal is excessive based on the guidelines prevaiing during that period, the quantum of compensation under challenge could not found to be excessive, following the ratio in National Insurance Company Ltd. v. Pranay Sethi :(2017) 16 SCC 680 and Ramachandrappa v. Manager, Royal Sundaram Alliance Insurance Company Ltd. : (2011) 13 SCC 236. Thus the appellant is not interested to proceed with this appeal further. This submission is recorded.
Accordingly, this appeal stands dismissed.
