For the reasons stated therein, the conditional order dated 05.02.2016 passed in First Appeal No. 130 of 2016 is set aside and the First Appeal is restored to file by condoning the delay, if any. Interim Application No. 1795 of 2020 accordingly stands disposed off.
Ms. Dwivdei, learned Advocate appearing for the Appellant Insurance Company has filed a praecipe dated 11.12.2021 which states that she has received instructions from Mrs. Lata Iyer, Chief Manager & In-Charge Mumbai Legal Hub of the Appellant to withdraw the Appeal. The praecipe is taken on record and marked "X" for identification. In view thereof, the Appeal stands disposed of as withdrawn.
Statutory deposit be transferred to the concerned Tribunal within a period of one week from today.
