As per office report, substitution application filed by the petitioner is within time. This application (IA No.12283 of 2021) seeking substitution of legal representatives of sole petitioner was filed on 22.07.2021. No objection has been filed to the said application. We accordingly allow the substitution application. Let legal representatives of petitioner be substituted by amending the memo of parties within 24 hours. Registry shall do the needful in the matter within aforesaid time.
Petitioner was serving in a school run by Cantonment Board, Roorkee. According to him, the said school was upgraded as higher secondary and petitioner served as officiating Principal in said school between 01.08.2006 to 31.07.2017. By means of this writ petition, petitioner has sought the following reliefs:-
“i) Issue a writ, order or direction in the nature of mandamus commanding directing the respondents to grant pay scale of Principal from 31.07.2006 to superannuation dated 31.07.2017 and further directed to fixed the pension of the petitioner accordingly (contained as Annexure No.1 & 2 to this writ petition).
ii) Issue a writ, order or direction in the nature of mandamus commanding directing the respondents to release the pending arrears of salary and pension for the post of Principal.
iii) Issue any other relief, which this Hon'ble Court may deem fit and proper in the circumstances of the case be passed in favour of petitioner.”
Learned counsel for the petitioner submits that petitioner has made a representation to the concerned authorities regarding his claim for salary. However, no decision has been taken thereupon so far.
We accordingly dispose of the writ petition by directing the competent authority i.e. Cantonment Executive Officer, Roorkee to take decision on petitioner’s representation dated 15.07.2019, Annexure no.6 to the writ petition, within three months from the date of presentation of certified copy of this order.
