This writ petition has been filed by Neraj Kumar with the prayer that respondents No. 1 and 2 may be directed to decide the matter pending with them, as raised by the petitioner vide Annexure P2 in the writ petition.
Reference is made to the notice served on respondents No. 3 and 4 by Labour Inspector, Shimla CircleII, Shimla, on the complaint of nonpayment of wages wherein it has been stated that enhanced wages have not been paid to the workers with effect from April, 2018 to April, 2019 and that the workers are entitled to get the notified rates of minimum wages for the aforesaid period in view of the revision of the wages from time to time. The said respondents were advised to make the payments in lieu of the arrears for the aforesaid period without further delay and produce the proof, failing which prosecution shall be launched against them in the competent Court of law for non production of record without further correspondence, under Section 15 of the Payment of Wages Act, 1936.
Mr. Naresh K. Gupta, learned counsel appearing for respondent No. 3, submits that they are in the process of complying with the aforesaid order of the Labour Inspector.
Having regard to the rival submissions and taking note of the facts of the case, we dispose of this writ petition with a direction to respondents No. 3 and 4 to make payment of the outstanding enhanced wages to the petitioner and other similarly situated persons within a period of two months from the date of production of a copy of this order.
Pending miscellaneous applications, if any, shall also stand disposed of.
