Judgment
Issue Notice.
Dr. N. Mozika, learned Senior counsel assisted by Ms. S.A. Shallam, learned counsel for the respondent accepts notice on behalf of the respondent, no further notice is required.
This writ petition has been filed assailing the show cause notice issued by the Additional Director General, DRI, Guwahati directing the petitioner to show cause before the lower authority (Additional Commissioner).
During the course of arguments it has been suibmitted in this regard by Dr. N. Mozika, learned Senior counsel that a similar matter with identical facts and circumstances has been disposed of vide order dated 19.02.2020 passed in WP(C) No. 52 of 2020 in the case of Subir Modak vs. The Additional Commissioner Customs (Preventive) North Eastern Region.
Learned counsel for the parties also are in agreement that the facts and circumstances are similarly situated. Accordingly, this writ petition is disposed of in terms of the order dated 19.02.2020 wherein the Adjudicatory Officer has been directed to pass an appropriate orders. Needless to say the petitioner is at liberty to raise any issue which is relevant to the case before the Adjudicatory Officer.
The writ petition stands disposed of. Copy of the order dated 19.02.2020 is kept on record.
