The petitioner is the registered owner of a Mahindra Tanker Lorry bearing registration No.KL-58-C-9086. The said vehicle was taken into custody on 20.08.2023 by the 4th respondent, the Secretary of the respondent Corporation, alleging that it was used for dumping sewage waste. The petitioner has filed this writ petition seeking a direction to respondents 2 and 4 to release the said vehicle.
Heard the learned counsel for the petitioner, the learned Government Pleader and the learned Standing Counsel appearing for the respondent Corporation.
It is submitted by the learned Standing Counsel and the learned Government Pleader that pursuant to Ext.P2, the petitioner has remitted the fine imposed by the Corporation and that the vehicle can be released to him.
In the light of the said submission, there will be a direction to the 4th respondent to release the vehicle bearing registration No.KL-58-C-9086 to the petitioner within a period of three days from the date of receipt of a certified copy of this judgment, if the vehicle is not required in connection with any other crime.
The writ petition is disposed of.
