This civil writ petition has been filed under Article 226/227 of the Constitution of India seeking issuance of a writ of Mandamus directing the respondents to recommend the petitioner bearing Roll No. 2231103797 under the General Category and place her at the appropriate place in the selection list/final result dated 27.07.2024 (P-10) for the post of TGT (Science), Mewat Cadre, against Advertisement No. 02/2023 dated 21.02.2023 (P-1), as the petitioner has secured 62.7 marks, which is equal to the cut-off marks for the General Category (Women), and is older in age than 13 recommended/appointed candidates, whose particulars are mentioned in para 11 of the writ petition and who were recommended vide order dated 13.08.2024 (P-12), along with all consequential benefits, including seniority and notional pay fixation. The petitioner is further seeking direction against the action of respondent No. 3-HSSC for not recommending her candidature and withholding her Roll No. 2231103797 till date, despite her being found eligible in view of the eligibility report received from respondent No. 2 vide email dated 26.01.2025 (P-15) for the post of TGT Science (Mewat Cadre) against the Advt. no.2/2023 dated 21.02.2023, Category Nos.7 and 12.
Learned State counsel, at the outset, places on record the revised recommendation for the post of TGT (Science) (ROH & Mewat Cadre) against Advertisement No. 2/2023, Category Nos. 07 & 12, which is taken on record as Mark “X”. Registry is directed to tag the same at appropriate place. He further submits that the present writ petition has been rendered infructuous, as the petitioner’s name has been recommended for the post of TGT (Science) against the aforementioned advertisement. Accordingly, he prays that the same may kindly be disposed of.
In view of the positive recommendation made by the Haryana Staff Selection Commission-respondent No. 3, respondent No. 2 is directed to act upon the same and pass appropriate orders in accordance with law and also issue the appointment letter in terms of the recommendation within a period of six weeks from the date of receipt of a copy of this order.
The present writ petition is disposed of as having been rendered infructuous.
Needless to say, the petitioner would be entitled to all the notional benefits strictly in terms of her merit. However, she will be entitled to salary only after the date of joining.
Pending miscellaneous applications, if any, shall also stand disposed of.
