When this matter was called out, there is no appearance on behalf of the appellants.
The order dated 3 October 2023 passed by this Court indicates that the respondent expired a considerable period of time ago and that the appellants were granted an opportunity to substitute the respondent with his legal representatives by orders dated 29 July 2022, 15 September 2022, 4 January 2023 and 2 June 2023. The substitution never took place. A further opportunity was granted by the Court on 3 October 2023 for the appellants to substitute the deceased respondent by his legal representatives, subject to costs.
That opportunity has also been allowed to go abegging.
