Judgment
The petitioner who is a Junior Instructor in Government Institute of Fashion Technology at Narakkal has been assigned for election duty. The petitioner submits that she has a nine months old breast feeding child and it will be dangerous for her to go to election duty along with the child during this pandemic period. The petitioner has submitted Ext.P3 representation before the District Collector in this regard.
I have heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
In the circumstances of the case, the writ petition is disposed of directing the 1st respondent-District Collector to consider Ext.P3 representation filed by the petitioner, taking into account the fact that the petitioner is having a nine months old breast feeding child and also considering Clause 3.4.2 of the Hand Book of Returning Officers. A decision in this regard shall be taken expeditiously at any rate within a period of two days.
