Judgment
Ravindra Maithani, J
Applicant Neetesh Srivastava is in judicial custody in FIR No.82 of 2019, under Sections 420, 409 and 120-B IPC and Section 3 of the Uttarakhand Protection of Interest of Depositors (In Financial Establishment) Act, 2005, Police Station- Kotwali Pithoragarh, District- Pithoragarh. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
Learned counsel for the applicant would submit that similar nature of many FIRs were lodged against the applicant, and has been granted bail by this Court. He would refer to the order dated 09.11.2023, passed by this Court in BA1 No.2423 of 2023, which reveals that, in fact, in that case, the FIR has similar allegations, as have been levelled in the instant FIR. The Court has granted bail to the applicant in that case.
Learned State Counsel admits these facts.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
