These petitions, for involvement of common facts and law, are being disposed of by this common judgment.

Execution Petition No.406 of 2024 has been filed for execution of judgment dated 02.12.2014, passed by this High Court in CWP No.8975 of 2014, titled Neeraj Kumar Sharma v. State of Himachal Pradesh & another; and Execution Petition No.405 of 2024 has been filed for execution of judgment dated 26.08.2014, passed by this High Court in CWP No.1594 of 2012, titled Suresh Kumar Sharma v. State of H.P. & another.

In sequel to orders dated 13.06.2024, Mr. Nishant Thakur, Additional Secretary (Education); Mr. Abhishek Chauhan, Executive Magistrate [Tehsildar] H.P. Secretariat, Shimla; and Mr. Rakesh Kumar, Senior Assistant, H.P. Secretariat, are present in Court.

From the material placed on record, it appears that orders passed by this High Court regarding extending benefit to petitioners-Neeraj Kumar Sharma and Suresh Kumar Sharma, stand complied with.

Though we are not satisfied with the explanation rendered by the Officers present in Court, particularly, by Mr. Abhishek Chauhan and Mr. Rakesh Kumar, however, considering unconditional apology tendered by both of them with persuasive submission made by Learned Advocate General and taking lenient view, we are closing these matters.

With the aforesaid observations, these matters are closed.
