Judgment
The present second bail applications have been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No. 20/2021 Registered at Police Station Kotwali Jhalawar, District Jhalawar for the offence(s) under Sections 341, 323, 307, 384, 427, 34 of IPC (in F.I.R.) & under Sections 341, 323, 384, 307, 427/34, 326 of IPC (in Order).
Counsel for the petitioners submits that the petitioners have been falsely implicated in this matter. Counsel further submits that petitioners and complainants are residents of same village and parties have settled their dispute by way of compromise. Counsel further submits that challan has already been presented in the court and conclusion of trial may take long time. Counsel further submits that the petitioners are in custody since 06.01.2021.
Counsel for the complainant has not disputed the fact of compromise between the parties.
Learned Public Prosecutor has opposed the bail applications.
Considering the material on record and taking into account the facts and circumstances of the case and also considering the period of custody and without expressing any opinion on the merits of the case, these petitions are allowed. Petitioners be admitted to regular bail subject to satisfaction of the trial Court. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance.
