Judgment
Petitioners seek quashing of FIR No. 260 dated 20.05.2025 under Sections 115, 126, 190, 191(2), 351(3) Bharatiya Nyaya Sanhita, 2023, Police Station Sirsa City, District Sirsa and all subsequent proceedings arising therefrom, on the basis of compromise.
Vide order dated 17.11.2025, this Court directed the parties to appear before the trial Court/Illaqa Magistrate for recording of their statements with regard to compromise.
In compliance of the order dated 17.11.2025, parties appeared before learned Chief Judicial Magistrate, Sirsa on 28.11.2025. Statement of the Investigating Officer, ASI Inder Sain No. 485/SRS, Police Station Kirti Nagar, Sirsa was also recorded. Learned Chief Judicial Magistrate, Sirsa has submitted her report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Relevant portion of the report is reproduced as under:
"1.FIR was registered against four (4) persons namely Neeraj, Sandeep @ Sonu, Rajesh@ Raju and Deepak @ Deepu. All has appeared before the court and made statements. As per statement of Investigating Officer, no accused was declared proclaimed offender in any case.
2.Name of Complainant was Jiwan Kumar S/o Chanan Ram and Injured Deepak S/o Jiwan Kumar. All of them appeared before the court and made statements.
3.Case is pending for argument on charge.
4.As per statement of parties, the compromise is considered to be genuine, voluntary, and out of free will of the parties.
5.As per statement of Investigating Officer accused Deepak @ Deepu has involved in FIR No 259/2020, PS City Sirsa. Remaining accused has not involved in any other case."
Learned State counsel and learned counsel for respondents No. 2 and 3 have not raised any dispute regarding the factum of compromise. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility.
Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.
FIR No. 260 dated 20.05.2025 under Sections 115, 126, 190, 191(2), 351(3) Bharatiya Nyaya Sanhita, 2023, Police Station Sirsa City, District Sirsa with all the subsequent proceedings arising therefrom, is quashed qua the petitioners.
Pending CRM(s), if any, also stand disposed of.
