Petitioner is presently posted as Head Mistress in Government Primary School, Digwali, Narendranagar, Tehri Garhwal. She rendered 28 years of service at the said School, which was earlier categorized as Durgam (Remote), while now it has been categorized as Sugam (Accessible).

Petitioner is a resident of District Dehradun, where, her family resides along with mother in-law, who is at present 80 years old and is suffering from Cancer. For these reasons, petitioner has moved an application under Section 27 of the Uttarakhand Annual Transfer for Public Servants Act, 2017 (hereinafter referred to as ‘the Transfer Act’) for her transfer on the basis of request. The application was sent by the petitioner through proper channel on 17.09.2026, which is annexed as Annexure No.1 to the supplementary affidavit filed by the petitioner. Supplementary affidavit filed by the petitioner is taken on record.

In the supplementary affidavit, petitioner has also annexed documents relating to the illness of her mother in-law, who is shown to be 81 years old in the OPD documents. But the documents annexed by petitioner nowhere disclosed the fact that petitioner’s mother in-law is suffering from Cancer.

Learned counsel for petitioner has made innocuous prayer before this Court for directing respondent No.3-Director, Primary School, Dehradun, to decide the petitioner’s application dated 17.09.2026 under Section 27 of the Transfer Act, within a stipulated time keeping in view of the long stay of petitioner at Government Primary School, Digwali, Narendranagar, Tehri Garhwal, and the illness of her aged mother in-law.

Learned State Counsel has no objection if such an order is passed by this Court.

Accordingly, the writ petition is finally disposed of. Respondent No.3 or Competent Authority under the Transfer Act, is directed to consider and decide petitioner’s application dated 17.09.2026 under Section 27 of the Transfer Act (Annexure No.1 to the supplementary affidavit) sympathetically, in the light of observation made in this order, within six weeks from the date of production of certified copy of this order.

Pending application, if any, stands disposed of.
