This first application under Section 482 of Bhartiya Nagrik Suraksha Sanhita has been filed on behalf of the applicant for grant of anticipatory bail.

Applicant is apprehending his arrest in connection with Crime No.486 of 2025 of Police Station-Kotwali, District-Raisen (MP) for commission of the offences punishable under Sections 34(2) of MP Excise Act.

Prosecution story in brief is that co-accused persons were found transporting more than 55.44 bulk liters of illicit factory made liquor without any licence and allegations against the present applicant are that he was also present there but fled away from the scene of incident.

4 . Learned counsel for the applicant submits that nothing has been recovered from the possession of the present applicant. He has been made accused on the basis of memorandum of co-accused persons. There are no criminal antecedents of the present applicant. Offence under section 34(2) of Excise Act is not made out. On above grounds, it is urged that applicant be granted the benefit of anticipatory bail.

Learned Government Advocate for the respondent/State on the other hand has opposed the application.

Looking to the facts and circumstances of the case, I deem it proper to release the applicant on anticipatory bail.

It is directed that in the event of arrest, the applicant shall be released on bail on his executing a personal bond in the sum of Rs.15,000/-(Rupees Fifteen Thousand Only) with solvent surety in the like amount to the satisfaction of the Arresting Officer/Investigating Authority.

The applicant shall further abide by other conditions enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and shall cooperate in the investigation otherwise this bail order shall automatically stand cancelled.
