O R D E R
The application, bearing IA No. 1702 of 2023 is filed under Rule 11 of NCLAT, Rules, 2016 for the replacement of Applicant, through whom the Government of Telangana is now to be represented instead of ‘Youth Advancement, Tourism and Culture, Department’.
It is averred in para 3 of the reply filed by the Respondent No.3 that Respondent No.3 (Government) entered into a Lease Agreement and Development and Management Agreement on 09.05.2007 with the Corporate Debtor to an extent of 4.337 Acres (17,551.748. Sq. Mts.). The Lease period commenced from May, 2007 for a period of 33 years subject to the terms and conditions mentioned therein.
Up till now, the State of Telangana has been prosecuted through the ‘Youth Advancement, Tourism and Culture, Department’ but the Applicant has now submitted that it has to be prosecuted through ‘Telangana State Tourism Corporation Limited’ which is a State Government Company.
Counsel for non-applicant/Appellant has not raised any objection in this regard, therefore, the present application is allowed and Respondent No.3 is hereby ordered to be replaced by ‘Telangana State Tourism Corporation Limited’. The complete particulars of Respondent No.3, now shall be ‘Telangana State Tourism Corporation Limited’, Government of Telangana having its office at D-Block, 2nd Floor, Telangana Secretariat, Hyderabad-500 081, Telangana, India.
Counsel for Applicant has submitted that after having been replaced by ‘Telangana State Tourism Corporation Limited’, the department does not want to file any other pleadings and shall adopt the pleadings which has been filed earlier.
The Registry is directed to make necessary correction in the memo of parties.
With these observations and directions, the present application is disposed of.
