The present Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for regular bail in connection with the Case Crime No.04 of 2025, registered at police station I .T.I ., District Udham Singh Nagar.

The applicant – Nazim is in judicial custody for the offence under Section 3/ 5/ 11 (1) of the Uttarakhand Protection of Cow Progeny Act, 2007.

On a secret information, the police party raided the spot on 03.01.2025. The present applicant and three co-accused were arrested on the spot. The police party recovered 30 kg of beef and cutting equipments etc. from the spot.

Heard Mr. Sanjay Kum ar, learned counsel for applicant and Mr. G.S. Sandhu, learned Additional Advocate General assisted by Mr. Deepak Bhardwaj, learned Brief Holder for respondent.

Mr. Sanjay Kumar, Advocate, has contended that the applicant is an innocent person. He was not present on the spot. He has been falsely implicated in the present matter. He does not have any criminal antecedents. He is a perm anent resident of District Udham Singh Nagar, therefore, there is no chance of his absconding, and, three co-accused have been granted regular bail by this Court.

Mr. G.S. Sandhu, learned Additional Advocate General has opposed the bail application orally.

Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.

The Bail Application is allowed.

Let the applicant – Nazim be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
