This petition is filed by the petitioner-accused under Section 482 of Cr.P.C. for quashing of criminal proceedings in C.C. No.3774/2016 registered by Kumaraswamy Layout Police Station (in Crime No.275/2015) pending on the file of XLIV Additional Chief Metropolitan Magistrate, Bengaluru for the offences punishable under Sections 498A, 504 and 506 read with Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act.
During the pendency of this petition, the learned Counsels for the parties have filed joint compromise application along with the joint affidavit of the parties. Both the petitioner and the respondent are present before this Court and they submit that they have compromised the matter and they want to lead happy marital life.
The learned Counsel appearing for the parties also submit that the parties have compromised the matter and they want to lead happy marital life and hence, they prayed for allowing the application and permit to compound the offences and to quash the criminal proceedings impugned herein.
The submission of the learned Counsel for the parties is placed on record. In view of the submission that the parties want to settle the matter and they want to lead happy marital life, they are permitted to compound the offences.
Accordingly, I.A. for compromise is allowed. Both the petitioner and the respondent are permitted to compound the offences.
Consequently, Criminal Petition is allowed. The criminal proceedings in C.C. No.3774/2016 registered by Kumaraswamy Layout Police Station (in Crime No.275/2015) pending on the file of XLIV Additional Chief Metropolitan Magistrate, Bengaluru for the offences punishable under Sections 498A, 504 and 506 read with Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act is hereby quashed.
