Judgment
This instant Appeal has been filed by Appellant-Navneet Kumar Gupta, Liquidator of Monnet Power Company Limited being aggrieved and dissatisfied by the Order dated 07.12.2020 passed by the Ld. NCLT, Mumbai Bench, Court No. II in I.A. No. 1438 of 2020 in C.P. (IB)/1696(MB)2017 whereby the Ld. NCLT has passed the following Order:
"The matter is taken up through Virtual Hearing (VC). Ld. Counsels for both the sides are present. Pleading in the IA has been complete. It is submitted by the LD. Counsel for the Appellant that unless orders are passed in the matter prejudice would be caused as the e-auction by the liquidator is scheduled on 10.12.2020. In view of the submissions list the matter before the regular bench on 17.12.2020 for hearing of the IA. Meanwhile the e-auction scheduled to be held on 10.12.2020 shall remain stayed till the next date of hearing i.e. 17.12.2020."
Now the matter has been listed before the National Company Law Tribunal, Cuttack Bench on 05th October, 2021.
We dispose of the Appeal with direction to the Ld. NCLT, Cuttack Bench to hear the matter expeditiously and dispose the same as the stay is operating in this matter as mentioned above.
With these observations, we dispose of the Appeal. No order as to costs.
The Registry is directed to upload this Order on the website of this Appellate Tribunal and communicate this Order to the Ld. NCLT, Cuttack Bench.
