I.A. No. 6758 of 2026 This is an application praying for grant of stay on proceedings before the Ld. NCLT. It is the submission of Ld. Sr. Counsel for appellant that vide Section 138(1)(a) of the Code, Bankruptcy Trustee shall apply for discharge within one year but, despite the said law, the Ld. NCLT once has granted an exclusion of 182 days, and against which impugned order, the present appeal was filed.

It is submitted during the pendency of the appeal, yet again an application is moved before the Ld. NCLT for further exclusion of 182 days and if the stay is not granted to the proceedings before the Ld. NCLT, it shall increase the litigation as already the first exclusion is pending in appeal before this Tribunal. On the other hand, the Ld. Counsel for respondent submits the said exclusion is sought for on both occasions because of non-cooperation of the Bankrupt.

Be that as it may, since the second application, as alleged is being heard by the Ld. NCLT and since this appeal is kept pending for 30/10/2026, it is submitted by the Ld. Sr. Counsel for appellant they would seek adjournment in Ld. NCLT for a date after the date fixed in this appeal.

In view of the above, I.A. No. 6758 of 2026 stands disposed of.
