Judgment
Prashant Kumar Mishra, J
The applicant has preferred this third bail application, as he is arrested in connection with Crime No.4/2016, registered at Police Station Nagarnar,
District Bastar (C.G.), for the offence punishable under Section 20-B of the NDPS Act.
Learned counsel for the applicant would submit that Mr. K. L. Deharia has not appeared before the trial Court yesterday and this was the 7th
occasion on which he failed to appear as a witness in the ongoing trial against the applicant.
Mr. Deharia is present in the Court. He assures and undertakes to attend the trial Court on the next date of hearing. His undertaking is made part
of the record of this bail application.
If Mr. Deharia fails to appear before the trial Court to record his evidence on the next date of hearing, the DGP shall constitute a departmental
enquiry against Mr. Deharia and submit a report to this Court upon completion of the departmental enquiry. Let the DGP submit the report within next
3 months.
The present bail application is dismissed considering the quantity of contraband seized from the accused person.
On receipt of the report from DGP, the Registry shall register a CRMP and place the same for consideration before this Bench. A copy of this
order be sent to the DGP by tomorrow.
