The applicants-accused persons, namely, Navdeep Singh alias Nubdeep Singh and Gurbaj Singh have invoked the inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, 1973 to quash the charge sheet dated 07.12.2013, cognizance order dated 23.05.2015 and the entire proceedings of Criminal Case No. 5106 of 2014, “State vs. Navdeep Singh and Another”, pending before the Court of Judicial Magistrate/Civil Judge (Junior Division), Udham Singh Nagar.

After completion of the investigation, the charge sheet was filed. The learned Magistrate took the cognizance under Sections 379 and 420 of IPC against the applicants-accused persons and passed the summoning order on 23.05.2015.

Heard Mr. Harshpal Sekhon, the learned counsel for the applicants, Mr. T.C. Aggarwal, the learned Deputy Advocate General for the State and Mr. Shailabh Pandey, the learned counsel for the respondent no. 2.

Both the applicants are present in-person before this Court and they are identified by Mr. Harshpal Sekhon, Advocate.

The respondent no. 2- Amar Jeet Singh, informant/owner of the stolen property/cheated person, is present in-person and he is identified by Mr. Shailabh Pandey, Advocate.

Both, the applicants and the respondent no. 2 submitted that they have filed a compounding application along with their affidavits with their free will and without any pressure.

The learned counsel for the respondent no. 2 submitted that the respondent no. 2 is willing to compound the said offences with his free will and without any pressure.

The learned counsel for the State has no objection.

Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the impugned charge-sheet, impugned cognizance order and entire proceedings of Criminal Case No. 5106 of 2014, “State vs. Navdeep Singh and Another”, pending before the Court of Judicial Magistrate/Civil Judge (Junior Division), Udham Singh Nagar, are quashed.

Resultantly, the impugned charge-sheet, impugned cognizance order and entire proceedings of Criminal Case No. 5106 of 2014, “State vs. Navdeep Singh and Another”, pending before the Court of Judicial Magistrate/Civil Judge (Junior Division), Udham Singh Nagar, are quashed.

The Criminal Miscellaneous Application (No. 1793 of 2022), filed under Section 482 of the Code of Criminal Procedure, is disposed of accordingly.
