Applicant Nav Vardhan Tiwari is in judicial custody in FIR/Case Crime No.187 of 2021, dated 05.04.2021, under Sections 8/20/60 of The Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Haldwani, District Nainital. He has sought short term bail on the ground that his father died on 09.11.2023 and he is the only son.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant would submit that the father of the applicant died on 09.11.2023 and he is the only son. A document with regard to cremation has been filed. Affidavit in support of short term bail application has been filed by the sister of the application.

Having considered, without adverting to the merits of the case, purely on the humanitarian ground, this Court is of the view that the applicant may be enlarged on short term bail for a period of two weeks from the date of his release.

Let the applicant be released on short term bail for a period of two weeks from the date of his release, on his executing a personal bond, to the satisfaction of the court concerned. It is further directed that, on the expiry of two weeks, the applicant shall surrender before the court concerned and intimation to that effect shall also be given to this Court.

The short term bail application stands disposed of.
