Judgment
This matter is taken up through Hybrid Mode.
Heard learned counsel for the parties.
The present intra Court Appeal has been filed by the appellants assailing the interim order dated 15th July, 2021 passed by the learned Single Judge in I.A. No.2846 of 2021 arising out of W.P.(C) No.33209 of 2020 (Annexure-1), whereby the application for amendment filed by the respondents/Petitioner-Sabyasachi Mohanty seeking to amend the Writ Petition to include the claim of regularization along with the main relief of challenge to the alleged termination, was permitted to be made. The same was allowed on the ground of initial stage of the Writ Petition and to avoid multiplicity of litigation.
At the outset, counsel for the appellants prays for permission to withdraw the present Writ Appeal with permission to the appellants to raise pleas as available before the learned Single Judge during the proceeding of the Writ Petition.
Mr. Lenka, learned counsel for the respondents has no objection.
In view of the above, the Writ Appeal is dismissed as withdrawn with the liberty as prayed for.
