Judgment
Deepak Gupta, J.—This petition arises out of an award passed by the Motor Accident Claims Tribunal, Kinnaur, Civil Division at Rampur Bushaher in MAC Case No. 62 of 2001. The learned Tribunal awarded an amount of Rs. 9,333/- alongwith interest and costs in favour of the claimant and held the Insurance Company liable to pay the same. This petition has been filed by the Insurance Company mainly on the ground that it was not liable to pay the amount, since the driver was not holding a valid and effective driving licence.
It is not disputed before me that three appeals arising out of awards from the same accident were dismissed by this Court vide judgment dated 9.12.2008 passed in FAO No. 337 of 2003 and connected matters. In the said judgment, this Court rejected the contention of the Insurance Company and held that Insurance Company is liable to pay the awarded amount.
In view of the aforesaid judgment inter-se the parties relating to the same accident, this petition is also rejected. No order as to costs.
