NATIONAL Insurance Company Ltd. has come up in appeal against the order of the District Forum dated 30.11.1999. Vide which the District Forum on a complaint filed by Ram Niwas Sharma had issued directions to the opposite party to pay a sum of Rs. 3,98,380/- alongwith interest at the rate of 12% per annum. Notice of the appeal was issued and in pursuance of which Mr. Pritam Saini, Advocate has put in appearance on behalf of the respondent. But today there is no appearance on behalf of the respondent.

WE have heard the Counsel for the appellant and have also perused the impugned order. During the course of arguments, Mr. R.M. Suri, Counsel for the appellant says that Insurance Company is ready to pay a sum of Rs. 3,70,380/- as assessed by the Surveyor to the complainant on furnishing the registration certificate of the vehicle. In view of the matter, the appeal is disposed of with the direction to the complainant to handover registration certificate of the vehicle in the office of the appellant-Insurance Company and Insurance Company is directed to pay a sum of Rs. 3,70,380/- to the complainant with interest at the rate of 10% per annum from the date of filing of the complaint till its realisation. The appeal stands disposal of accordingly. Appeal disposed of.
